Entrepreneurs’ Rights and the State: Dissertation Abstract by Zhanna Samosud


The Research Institute of Public Law has presented the dissertation abstract by Zhanna Samosud titled:
“Public Administration of Ensuring the Rights and Legitimate Interests of Entrepreneurs: A Comparative Analysis (Ukraine, Poland, Czech Republic)”.
This dissertation explores the complex issue of developing legal mechanisms to protect entrepreneurship in EU countries and Ukraine, particularly in the context of war, reconstruction, and European integration.
Key focus areas of the dissertation include:
a systematic overview of public administration tools for supporting small and medium-sized businesses;
comparative analysis of the administrative and legal status of institutions that protect entrepreneurs’ rights in Poland, the Czech Republic, Romania, Slovakia, and Croatia;
proposals to create an independent Business Ombudsman institution in Ukraine;
emphasis on digital tools, e-governance, and entrepreneurship support platforms;
justification for integrating entrepreneurship into formal education and developing support mechanisms for youth and migrants.
Scientific novelty: For the first time in Ukrainian administrative legal science, based on European models, the dissertation substantiates the principles of transparent administration, the presumption of entrepreneurs’ good faith, the division of functions between executive authorities, subordinate regulation, and administrative procedures.
In the review by the Director of the Research Institute of Maritime and Space Law, Professor, Doctor of Legal Sciences Andriy Ivanyshchuk, it was emphasized:
“Zh.O. Samosud’s dissertation is a timely and comprehensive study that not only demonstrates a high scientific standard but also directly contributes to the post-war recovery of Ukraine as a strong and law-governed state.”

In conclusion, it was noted that Zhanna Oleksandrivna Samosud deserves to be awarded the degree of Candidate of Legal Sciences, specialty 12.00.07.
